The Elder Law and Guardianship Committee of the Probate & Trust Law Section of the Philadelphia Bar Association and the Philadelphia Orphans' Court are co-hosting a virtual CLE program entitled New Guardianship Right to Counsel (ACT 61): Everything You Need to Know to Begin Representing Alleged Incapacitated Persons in the Philadelphia Orphans’ Court on February 13, 2024 from 9:00 AM-1:00 PM Eastern.
In December 2023, Pennsylvania enacted adult guardianship reform legislation (Act 61 of 2023), to be implemented by mid-2024. One of the most important changes is an automatic right to counsel for Alleged Incapacitated Persons, who face a significant loss of fundamental civil rights. The Honorable Sheila Woods-Skipper, Administrative Judge of the Philadelphia Orphans’ Court, will provide introductory remarks to begin the program.

Any attorney interested in accepting Philadelphia court appointments to represent Alleged Incapacitated Persons (AIP) and Incapacitated Persons in guardianship proceedings should attend this practical, nuts-and-bolts training – no prior Orphans’ Court experience required.

The Pennsylvania Continuing Legal Education Board has set the following requirements for 2023 and 2024:
For compliance periods ending in 2022 and thereafter, or until further modification by the Board, the number of credits earned through accredited pre-recorded/on-demand (asynchronous) programs shall not exceed six (6).
Credits earned through accredited live-online (synchronous) programs shall be treated the same as traditional classroom courses. Only credits earned through live-online and in-person/classroom courses taken during this period may carry forward (up to two compliance periods).
