Philadelphia Bar Association logoThe Elder Law and Guardianship Committee of the Probate & Trust Law Section of the Philadelphia Bar Association and the Philadelphia Orphans' Court are co-hosting a virtual CLE program entitled New Guardianship Right to Counsel (ACT 61): Everything You Need to Know to Begin Representing Alleged Incapacitated Persons in the Philadelphia Orphans’ Court on February 13, 2024 from 9:00 AM-1:00 PM Eastern. 

In December 2023, Pennsylvania enacted adult guardianship reform legislation (Act 61 of 2023), to be implemented by mid-2024. One of the most important changes is an automatic right to counsel for Alleged Incapacitated Persons, who face a significant loss of fundamental civil rights. The Honorable Sheila Woods-Skipper, Administrative Judge of the Philadelphia Orphans’ Court, will provide introductory remarks to begin the program.

    The Pennsylvania Continuing Legal Education Board has set the following requirements for 2023 and 2024:

    For compliance periods ending in 2022 and thereafter, or until further modification by the Board, the number of credits earned through accredited pre-recorded/on-demand (asynchronous) programs shall not exceed six (6).

    Credits earned through accredited live-online (synchronous) programs shall be treated the same as traditional classroom courses. Only credits earned through live-online and in-person/classroom courses taken during this period may carry forward (up to two compliance periods).
