The Legal Rights of Persons with Disabilities Committee of the Philadelphia Bar Association is hosting a virtual presentation entitled Disability Discrimination in Employment on June 10, 2025 from 12:00 PM-1:00 PM Eastern.
The Americans with Disabilities Act (ADA) requires employers to provide reasonable accommodations to employees living with disabilities if the employer knows of the disability unless doing so would present an undue hardship. The employment reasonable accommodation process is an interactive one between the employer and employee living with a disability. This process is used to identify accommodations that will enable the employee to perform their essential job duties effectively and then implement those accommodations.
The employer and employee first engage in discussions regarding the employee's needs and limitations, and potential accommodations by the employer. The employer may then request relevant medical information, review the job description, and identify potential accommodations. The employer and employee collaborate to select accommodation that is effective and will not cause an undue hardship for the employer. Once the accommodation has been implemented, the employer and employee will follow up to ensure the accommodation's effectiveness and make any necessary adjustments. This process ensures that the accommodation is specifically tailored to the specific needs of the employee living with a disability and to the specific needs of the job.
